Woman sues bar for drunken driving accident

A Bluffton woman was drinking under age at a local bar and got behind the wheel of her car before crashing leaving her paralyzed and now she's suing the bar that served her and the DOT, blaming them for her accident.

Remember that law suit in where a McDonald’s drive-thru customer sued the mega fast food chain for serving her coffee that was too hot? ABC called the lawsuit “the poster child of excessive lawsuits,” and now Charleston might have their own for the record books.

A report by Midlands Connect says a woman is suing a Bluffton bar saying the bartender didn’t check her age before serving her nor did he determine how drunk she was before serving her on the night of the 2009 wreck that paralyzed her.

Chelsea Hess, who was then 20 years old, is a paraplegic because of the accident that occurred after she was served at Jock’s Sports Grill.

If that’s not enough, she’s also suing the state Department of Transportation, saying the agency failed to properly maintain the shoulder of the road where her car crashed.

Both the company that owns the bar and the DOT denied Hess’ claims in court papers and their lawyers say Hess is responsible for her accident.

Back to the McDonald’s coffee case, Liebeck, the 79-year-old woman who sustained 3rd degree burns from the hot coffee that spilled between her legs was ultimately awarded $640,000 for her hospital bills and punitive damages. Only time will tell what will happen in Hess’ case.
